These Terms form a binding agreement between you and Jobsophy. By accessing or using any Jobsophy site or service, you accept these Terms. If you do not agree, do not use our services.
Users who violate these Terms may have their access to the Site suspended or terminated at our discretion.
Jobsophy may revise these Terms at any time by posting an updated version on this page. You are responsible for reviewing the most current Terms periodically, as they are binding.

4. Use of the Site & Content

4.1 Permitted Use
The information and services available on this Site are intended for job seekers seeking employment and employers seeking to recruit staff. Job seekers may access, print, and download content strictly for personal, non-commercial use. Employers may access and use the data for recruitment purposes as part of their business operations. Any other use of the Site or its content outside these purposes is prohibited without prior written consent.
4.2 Prohibited Use
Unauthorized reproduction, modification, distribution, or public display of Jobsophy content—including text, images, graphics, videos, logos, and software—is strictly prohibited. All copyright, database rights, and intellectual property rights in the Site and its content belong to Jobsophy Limited.
Additionally, any code developed by Jobsophy to generate or display content is protected by copyright and may not be copied, reverse engineered, modified, or adapted. Misuse of Jobsophy content that could damage its reputation, cause confusion, or infringe on its rights is strictly forbidden.

5. Fair & Professional Conduct and Compliance with Equality Laws

By using this Site, you agree to interact fairly and professionally with job seekers and individuals responding to job postings, in compliance with the Employment Rights Act 1996, Equality Act 2010, and all relevant laws. You also confirm that all job postings and use of the Candidate Database will adhere to the Equality Act 2010 and the Code of Practice on Employment provided by the Equality and Human Rights Commission. Discrimination against job seekers is strictly prohibited.
5.1 Prohibited Activities
You must not engage in any activity that could harm the reputation of Jobsophy Limited or the Site.
5.2 Indemnity
If you breach this obligation or any other Terms, you agree to indemnify Us against any claims brought against Us as a result.
5.3 Suspension or Termination
We reserve the right to suspend or terminate your access if we have reasonable grounds to believe you have misused or improperly processed information from the Site.

6. Compliance with Employment Regulations

6.1 Platform Role
Jobspohy is not an Employment Agency or Employment Business
In accordance with the Conduct of Employment Agencies and Employment Businesses Regulations 2003, Jobsophy is solely an online platform that facilitates the connection between job seekers and recruiters.
Jobsophy is not an employment agency or an employment business and does not engage in, nor is responsible for, any of the following activities:
Introducing, recommending, or supplying job seekers to recruiters or vice versa.
Assessing the suitability of candidates for specific roles.
Negotiating employment terms, salaries, or contracts.
Participating in any hiring decisions or employment arrangements.
Handling payroll, work permits, or compliance with employment laws.
All interactions, negotiations, and agreements between job seekers and recruiters occur independently of Jobsophy. We do not vet, verify, or guarantee the accuracy, completeness, or legality of any job postings, candidate information, or employment offers.
Users acknowledge that they are solely responsible for conducting their own due diligence before entering into any professional arrangements.
Jobsophy assumes no liability for any losses, damages, disputes, or claims arising from the use of our platform, including but not limited to misrepresentation, fraud, non-payment, discrimination, or contractual breaches by users.
6.2 Responsibilities of Job Seekers and Recruiters
- Job Seekers: It is your responsibility to verify the details of job opportunities and ensure you meet any legal or industry-specific requirements before applying.
- Recruiters: You must confirm job seekers’ identity, qualifications, and eligibility to work before making hiring decisions. Where professional qualifications are required, or job seekers will be working with vulnerable persons or children, you should obtain copies of relevant certifications, references and conduct a criminal records check.
6.3 Search and Screening Tools
Any search or screening tools provided by Jobsophy are intended as an aid but are not a substitute for due diligence.
Employer Obligations

By using our AI tools, employers agree:

7. Job Advertising

7.1 Job Advert Posting & Approval
Job advertisements will go live only after we have vetted their content to ensure compliance with the rules outlined below. We may need to contact customers for additional information, which could delay the posting time.
7.2 Compliance with Posting Rules
We enforce specific rules regarding job content and formatting to ensure that job seekers receive clear and informative search results. At our discretion, and without liability, we reserve the right to remove any job advertisement that breaches these rules.
7.3 Job Posting Rules
- No Manipulation: Duplicate listings and excessive keyword use to manipulate search rankings are prohibited. Inaccurate, false, or misleading information is not allowed.
- Genuine Job Offers Only: Ads must represent real employment opportunities. Unpaid surveys, affiliate programs, business ownership roles, franchise opportunities, or pyramid schemes are not allowed.
- No Fees for Job Seekers: Employers cannot charge fees or require job seekers to buy materials or merchandise.
- No Contact Information in Descriptions: Job postings must not include telephone numbers, URLs, or email links.
- Anti-Discrimination Compliance: Ads must follow anti-discrimination laws. We may remove or modify ads that appear discriminatory.
- No Fraud or Illegal Activity: Job ads must not promote scams, phishing, junk mail, chain letters, or fraudulent activities. Reports of such will be investigated and may result in account termination.
- it is not allowed to advertise sexual services or seek employees for jobs of a sexual nature.
- it is not allowed to advertise material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone.
- Availability: Job postings must remain accessible for job seekers. If a listing becomes unavailable, we may remove it without notice.
- No posting jobs, ads, or content that promote or link to Jobsophy competitors or unrelated services.
-Commission-only jobs must clearly state the pay structure and describe the product or service being sold.
- No Harmful or Offensive Content: Ads must not contain or promote:
- Hate speech, discrimination, harassment, or threats.
- Illegal or unauthorized copies of copyrighted material.
- Pornographic, explicit, or exploitative content.
- Instructions for illegal activities, hacking, or privacy violations.
- Solicitation of passwords or personal information from users.
- No links to other sites that contain the kind of content that falls within the descriptions above
To improve ad performance, we may modify job details, layout, or formatting at our discretion.
Failure to comply with these rules may result in removal of job listings and account suspension and we reserve the right to report any suspicious activity to the relevant authorities.
7.4 Use of Employer Branding
By submitting a job advertisement, you grant us a global, non-exclusive, royalty-free license to use your name, trademarks, and logos ("Employer Branding") as part of our services. This includes displaying your branding on job listings and associated materials.
Additionally, we may feature your Employer Branding in promotional content, such as our website and brochures, and showcase examples of services delivered or materials published on your behalf.

8. Responses to Advertisements

8.1 No Guarantee of Responses or Suitability
Jobsophy does not guarantee any specific number of responses to job advertisements, nor do we make any representations about the suitability, qualifications, or capabilities of applicants. Employers are solely responsible for reviewing, verifying, and assessing the qualifications, credentials, and suitability of all applicants responding to job advertisements. We recommend that employers exercise due diligence when considering candidates for roles.
8.2 Modification of Job Advertisements
We reserve the right to modify or update job advertisements at any time, including altering job titles, descriptions, salary information, or any other details related to the posted positions. Employers may also request modifications to their job ads; however, such requests are subject to our approval and may be implemented at our discretion. Any changes made to job listings will be reflected on the platform promptly, but we do not guarantee that updates will be communicated to applicants.
8.3 Ownership of Content
All content, materials, and formats related to job postings, including but not limited to text, graphics, logos, images, and media, are the exclusive property of Jobsophy or its licensors. By submitting job advertisements to the platform, employers grant Jobsophy a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content for the purpose of the platform’s operation. Any unauthorized use, modification, reproduction, or distribution of job advertisement content is strictly prohibited. Employers acknowledge that they do not retain ownership rights over content hosted on our platform.
8.4 Platform Testing To improve the functionality, usability, and performance of the Jobsophy platform, we may periodically conduct tests or make changes to certain features of the platform. These tests may include, but are not limited to, changes to the user interface, functionality, or data processing mechanisms. Testing may occur without prior notice, and Jobsophy will not be held responsible for any disruptions or issues arising from such tests. By using the platform, you agree to participate in these tests, which may impact your experience temporarily.

9. Third-Party Sites

Job postings on our site may also appear on third-party recruitment websites under our agreements with such platforms.

10. IR35 Tax Legislation Compliance

Recruiters must comply with IR35 tax legislation when posting job adverts, particularly for roles involving independent contractors, freelancers, interim workers, or consultants. It is the recruiter’s responsibility to assess IR35 status with reasonable care. Failure to do so may result in the recruiter becoming liable for any omissions.

11. Data Protection & Privacy

Any personal data accessed or processed by a Advertiser through the Site remains the sole responsibility of the Advertiser. The Advertiser acknowledges that they are the data controller under UK GDPR and are accountable for its processing.
Jobsophy Limited retains all rights to its database, intellectual property, and content. Use of the Site does not grant you any ownership or proprietary rights over these materials.

12. Disclaimer: No Legal Advice & Accuracy of Information

The information on this site is for general informational purposes only and does not constitute legal, financial, or professional advice. Jobsophy Limited does not guarantee the accuracy, completeness, or timeliness of any content. Laws and regulations change frequently,
it is the sole responsibility of job seekers and recruiters to verify legal requirements and ensure compliance before making employment-related decisions.
While we strive to provide reliable information, we do not warrant that the site is free from errors, defects, or inaccuracies. To the fullest extent permitted by law, Jobsophy Limited disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the site, its content, or its services will be error-free, uninterrupted, or free from viruses or harmful components. Users access and use the site at their own risk, and Jobsophy Limited is not responsible for any costs related to servicing or replacing equipment or data.
Jobsophy Limited shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to lost profits, lost data, business interruption, or employment opportunities resulting from the use or inability to use the site. Our maximum liability arising from your use of the site will not exceed £5.
This site may contain links to third-party websites for convenience. Jobsophy Limited does not endorse, control, or take responsibility for the content or accuracy of any linked sites. Accessing third-party websites is at the user’s own risk.
Recruiters and job seekers must conduct their own due diligence and seek independent legal or professional advice where necessary. Jobsophy Limited is not responsible for any losses, claims, or damages resulting from reliance on site content or inaccuracies therein.

13. Applicant and Application Data

13.1 Restrictions on Use of Database Products
You may not:
(a) Supply, sell, or license material from the Database Products, or its copy, to any third party, including others within your group.
(b) Use automated methods (e.g., scraping) or unauthorized means to download, search, or view the Database Products.
(c) Contact individuals from the Jobseeker Data for purposes other than finding candidates for job vacancies or as consented to by the individuals. Always comply with our Privacy Policy.
(d) Access our Database Products from a system that is not fully patched or lacks up-to-date antivirus software.

14. Application Data

14.1 Management of Application Data
When a Jobseeker responds to an advertisement, their application details will be loaded into your account. You can record notes, communicate with applicants via our app, and track their progress.
14.2 Retention and Deletion of Application Data
We may delete Application Data in line with our data retention policies, including when a Jobseeker deletes their profile, without prior notice.
14.3 Compliance with Data Protection Regulations
As a data controller, we comply with the General Data Protection Regulation (GDPR) regarding Application Data, which may include disclosing data to the Jobseeker upon their request.

14.4 Joint Controller Responsibilities
You are a joint controller of Application Data on your account. You agree to:
- Ensure the accuracy of any entered data.
- Delete Application Data when no longer required.
- Respond promptly to any Jobseeker requests to exercise GDPR rights, including those forwarded by us.
14.5 Use of Applicant Tracking Systems (ATS)
If using an ATS, Jobseekers' applications will be sent directly to your ATS. As the data controller of Jobseeker ATS Data, you agree to:
- Delete ATS Data when no longer required.
- Respond to any Jobseeker requests related to GDPR rights.
- Use the data solely for processing the specific job application, consistent with GDPR and your privacy notice (if provided).

14.6 Use of Application Manager
If you do not use an ATS, you may manage applications through our internal system. You must download and save any applicant information to your databases in compliance with these Terms and data protection laws.
14.7 Right to Erasure
If a Candidate exercises their right to erasure under GDPR, we will comply. This means any application or supporting data for your job ads will be removed from our system. Once erased, you cannot download or transfer Applicant information, even if the ad is still live.

15. Deletion of Jobseeker Data

15.1 Retention Period
Typically, the search for a suitable candidate is concluded within three months.
15.2 Consent or Deletion
You agree to either obtain consent from the Candidate to retain their data or delete it after three months, unless you have another legal basis to retain it.

16. Job Seekers

16.1 Permitted Use
Job Seekers, also referred to as "Registered Users," agree to use all resources on the JobSophy site solely for personal, non-commercial purposes. They are strictly prohibited from sharing, selling, distributing, or disclosing any JobSophy content, including job listings, to third parties or other websites.
16.2 Application Requirements
Job Seekers are not permitted to post a CV or profile, or apply for jobs, on behalf of others. All applications must be submitted by the individual seeking employment.
16.3 Account Security
Job Seekers may not share their JobSophy login credentials with any third party. You are responsible for maintaining the confidentiality of your account, profile, and password. Any sharing of login details, whether temporary or permanent, is strictly prohibited.
16.4 Responsibility for Account Activity
You are fully responsible for all activity associated with your JobSophy account, whether authorized or not. If you become aware of any unauthorized use of your account, profile, or password, you agree to notify JobSophy immediately.
16.5 Prohibited Content
Job Seekers must not post a CV or profile that:
- Is not genuine or misrepresents their identity or qualifications.
- Advertises or promotes products or services.
- Contains defamatory, offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, or menacing content.
- Includes material likely to cause annoyance, inconvenience, embarrassment, anxiety, or harassment to others.
- Contains links to pornographic, indecent, or sexually explicit material.
JobSophy reserves the right to determine, at its sole discretion, whether any content violates these guidelines.
16.6 Security Violations
Violations of system or network security may result in civil and/or criminal liability. JobSophy will investigate any such incidents and may cooperate with law enforcement authorities in prosecuting users involved in security breaches or other violations.

17. Credit Usage Policy (No Refunds)

By purchasing credits on Jobsophy, you agree to the following terms:
17.1 Non-Refundable Credits
All purchased credits are non-refundable and cannot be exchanged for cash or other payment methods.
Once credits are added to your account, they remain available for use but cannot be withdrawn or refunded.
17.2 Flexible Credit Usage
Credits can be used for various advertising services within our platform.
If you are unable to use credits for a specific service, you may allocate them to another available advertising option.
17.3 No Expiry on Credits
Your credits will remain in your account indefinitely and do not expire.
You may use them at any time for eligible services on our platform.
17.4 User Responsibility
It is the user's responsibility to ensure they purchase the correct amount of credits needed.
We provide tools and support to help you plan and optimize your credit usage before making a purchase.
17.5 No Partial Refunds for Unused Credits
If only a portion of your credits is used, the remaining balance will stay in your account for future use.
Refunds will not be issued for unused or partially used credits.
17.6 Exceptions & Disputes
In cases of technical issues or billing errors, please contact our support team at support@jobsophy.com.
Any disputes regarding credit purchases must be submitted within 14 days of the transaction for review.
We will investigate and resolve disputes at our sole discretion.
17.7. Fraud Prevention & Chargeback Policy
We strictly prohibit fraudulent transactions, including unauthorized credit card use or chargebacks.
If a chargeback is initiated on a legitimate credit purchase, we reserve the right to:
Suspend or terminate your account without notice.
Permanently ban users found engaging in fraudulent activity.
Pursue legal action and recover any losses incurred.
If you believe a charge was made in error, please contact our support team before disputing the transaction with your payment provider.
By purchasing credits, you acknowledge and accept this policy. If you have any concerns before purchasing, please contact our support team for assistance.

18. Primary Jurisdiction (UK)

These Terms & Conditions, and any disputes arising from or related to your use of Jobsophy, shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. By using Jobsophy, you agree that any legal action or proceeding shall be exclusively brought before the courts of England and Wales.
18.1. Local Compliance for Users in Germany, France, Spain
If you are accessing or using Jobsophy from Germany, France, Spain, you acknowledge that certain mandatory consumer protection, employment, and data privacy laws may apply in your jurisdiction. While the governing law remains English law, we comply with local regulations, as outlined below:
Germany: To the extent required by German law, Jobsophy complies with the German Civil Code (BGB), the Federal Data Protection Act (BDSG), and any applicable employment laws. However, disputes shall still be subject to the jurisdiction of English courts.
France: Jobsophy adheres to the French Consumer Code and Loi Informatique et Libertés (French data protection law). However, unless otherwise required by mandatory French law, disputes shall be resolved in the courts of England and Wales.
Spain: We comply with Spanish consumer protection laws, including Ley General para la Defensa de los Consumidores y Usuarios. However, disputes shall be governed by English law and resolved in English courts.
18.2. Dispute Resolution for EU Users If you are based in the European Union (Germany, France, or Spain) and have a consumer-related dispute with Jobsophy, you may have the right to use an alternative dispute resolution (ADR) mechanism, as required under EU law.
18.3. No Foreign Jurisdiction Users waive any right to bring claims in any jurisdiction other than England and Wales, including claims under foreign employment laws or regulations.
18.4. Mandatory Dispute Resolution Before initiating legal action, users must first attempt to resolve disputes through direct negotiation with Jobsophy. If unresolved, disputes may be referred to mandatory mediation in London, UK, before proceeding to court.
18.5. No Class Actions Users agree that all claims must be brought individually, and waive any right to participate in a class action, collective, or representative proceeding against Jobsophy.
18.6. Business Users & Waiver of Consumer Protections If you are using Jobsophy in a business capacity (i.e., as a recruiter or company) rather than as a consumer, you agree that:
You waive any rights to rely on consumer protection laws of Germany, France, Spain, or Turkey.
All disputes will be governed exclusively by English law and resolved in the courts of England and Wales.

By using this Site, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
